* Aceh government should have more focus on how to improve the life of people in Aceh alone. If this continues it soon this problem, this problem soon, so this will hinder the welfare of the people of Aceh acceleration, "said Minister Gamawan Fauzi at the Presidential Office, Jl Medan Merdeka Utara, Jakarta, Monday (04/01/2013).

JAKARTA - A wave of euphoria after the establishment of the Aceh Qanun flag and emblem, is still going on. Supposedly compared busy with flags, Aceh Provincial Government better focus on improving the welfare of its citizens.

"It should be more focus on how the Aceh government welfare for the people of Aceh alone. If this continues it soon this problem, this problem soon, so this will hinder the welfare of the people of Aceh acceleration," said Minister Gamawan Fauzi at the Presidential Office, Jl Medan Merdeka Utara, Jakarta, Monday (04/01/2013).

Gamawan asserted, Aceh may not use or wear any emblems similar to GAM identity.

"There are 12 points that we evaluate, we submit the evaluation Minister in accordance with laws and regulations in force. Both are legitimate concerns regarding drafternya or substance or material," said Gamawan.

As per the MoU Between The Government Of The Republic Of Indonesia And The Free Aceh Movement (MoU) in article 1.1. Law on the Governing of Aceh and 1.1.5, Aceh has the right to use the symbols of the region including the flag, emblem and hymn.

Further in accordance with Law no. 11 Year 2006 on the Governing of Aceh, which is derived from the Helsinki MoU, in Article 246, namely:

1. The flag is the national flag of the Republic of Indonesia based on the Constitution of the Republic of Indonesia Year 1945.

2. In addition to Red and White Flag as referred to in paragraph (1), the Government of Aceh to determine and set the flag as a symbol of the Aceh region reflects privilege and specificity.

3. Aceh flag as a symbol referred to in paragraph (2) is not a symbol of sovereignty and not be treated as the flag of sovereignty in Aceh.

4. Further provisions concerning the form of the flag as a symbol referred to in paragraph arranged in Aceh Qanun guided by the legislation.

JAKARTA - Gelombang euforia setelah penetapan Qanun Aceh tentang Bendera dan Lambang, masih terjadi. Seharusnya dibanding sibuk mengurusi bendera, Pemprov Aceh lebih baik fokus meningkatkan kesejahteraan warganya.

"Mestinya Pemda Aceh lebih fokus bagaimana menyejahterakan masyarakat Aceh sendiri. Kalau begini terus kan sebentar lagi ada masalah ini, sebentar lagi masalah ini, jadi ini akan menghambat percepatan kesejahteraan masyarakat Aceh," kata Mendagri Gamawan Fauzi di Kantor Presiden, Jl Medan Merdeka Utara, Jakarta, Senin (1/4/2013).

Gamawan menegaskan, Aceh tidak boleh menggunakan atau memakai lambang yang mirip dengan identitas GAM. 

"Ada 12 poin yang kita evaluasi, yang kita sampaikan sebagai evaluasi Mendagri sesuai dengan peraturan perundang-undangan yang berlaku. Baik yang menyangkut legal drafternya maupun menyangkut substansi atau materinya," papar Gamawan.

Sesuai MoU Between The Government Of The Republic Of Indonesia And The Free Aceh Movement (MoU Helsinki) dalam artikel 1.1. Undang-undang tentang Penyelenggaraan Pemerintahan di Aceh dan 1.1.5, Aceh memiliki hak untuk menggunakan simbol-simbol wilayah termasuk bendera, lambang dan hymne.

Selanjutnya sesuai dengan UU No. 11 Tahun 2006 tentang Pemerintahan Aceh yang merupakan turunan dari MoU Helsinki, dalam Pasal 246 yaitu :

1. Bendera Merah Putih adalah bendera nasional dalam Negara Kesatuan Republik Indonesia berdasarkan Undang-Undang Dasar Negara Republik Indonesia Tahun 1945.

2. Selain Bendera Merah Putih sebagaimana dimaksud pada ayat (1), Pemerintah Aceh dapat menentukan dan menetapkan bendera daerah Aceh sebagai lambang yang mencerminkan keistimewaan dan kekhususan.

3. Bendera daerah Aceh sebagai lambang sebagaimana dimaksud pada ayat (2) bukan merupakan simbol kedaulatan dan tidak diberlakukan sebagai bendera kedaulatan di Aceh.

4. Ketentuan lebih lanjut mengenai bentuk bendera sebagai lambang sebagaimana dimaksud pada ayat diatur dalam Qanun Aceh yang berpedoman pada peraturan perundang-undangan.
